Mobile Apps, Inc., its affiliates and agents ("Mobile Apps"), as owner and operator of MobileChat, respects the privacy of visitors to this website, http://mobilech.at (the "Site") and users of any products and services available or enabled via the Site ("Products and Services"). We recognize that many visitors to various websites are concerned about the information they may provide to us, and how we treat that information. This Privacy Policy discloses how Mobile Apps, together with MobileChat, gathers, uses, shares and protects information collected about visitors to the Site. By using our Site, you consent to the collection, use and disclosure of all information you provide, including your Personal Identification Information (as defined herein), by Mobile Apps in accordance with the terms of our Privacy Policy in effect at that time. What Information Does Mobile Apps Gather?

Mobile Apps voluntarily collects information from visitors who express an interest in purchasing and using the MobileChat application for Apple's iPhone. Mobile Apps collects two different types of information: (1) Personal Identification Information, which may include usernames, names, e-mail addresses, physical addresses, or phone numbers, and (2) Instant Messaging and Other Blog Posts to the Site, including cache memory of previous posts, and any information provided by you in such posts. The information collected is used exclusively to facilitate the servicing of MobileChat customers and to improve performance of the MobileChat application on Apple's iPhone and other devices.

Users may access the Site without being required to provide any Personal Identification Information if they wish. Visitors to the Site do not need to identify themselves to read posted materials or access other of the Site's content. However, certain Personal Identification Information may be needed in order to access special features of the Site, or to use certain of the Products and Services offered on the Site.

MobileChat may periodically conduct surveys, usability studies, contests and other programs that help MobileChat improve and promote its Products and Services. Visitors to the Site may voluntarily participate in these programs and as a condition of such participation, they may be asked to provide additional demographic information. MobileChat may collect such additional information that visitors voluntarily provide, including, without limitation, gender, age, income level, or various cellular phone and PDA usage habits. Personally identifiable information collected by MobileChat in conjunction with such voluntary surveys, usability studies, contests and other voluntary programs will not be shard with any sponsor or third party without your consent.

Visitor Information

The MobileChat Site server automatically collects and records visitor information based upon your activity on the MobileChat Site, such as visitor IP addresses, domain names, usernames, passwords, buddy lists, conversations, away messages, and/or profile content. An IP address is often associated with the place from which you enter the Internet such as your Internet service provider. This and other information is associated with you as an individual. MobileChat may use information about user behavior, user experience, user equipment, computing and Internet environment to improve the performance of the MobileChat Site. MobileChat will NEVER sell or distribute any of your information to third parties without your explicit consent; all information retained and "cached" on the server is purely to allow for the operation of the Site or for other purposes as set forth herein.

Communication Information

If you communicate directly with MobileChat by e-mail, website form, phone or letter, MobileChat may collect and store a record of your communication. MobileChat may use your communication information, which may include usernames and/or contact information, to respond to your issues and inquires. The communication information that you provide to any of MobileChat's third party partners, such as Apple, will also enable such partners to let us know that you have contacted them. Such communication information may be used to distribute information back to you about MobileChat, its Products and Services, or other promotional or informational communications from MobileChat.

Cookies

Cookies are data that a Website transmits to your computer's hard drive through your browser to enable the Website to recognize your browser, record and store your information and occasionally track your viewing habits for statistical purposes. The Site uses cookies to collect this type of information to deliver targeted content to you, and potentially tailor and enhance your experience on the Site. You can disable cookies through the options available on the web browser you use to access the Site; however, some features of the MobileChat Site may not work as intended as a result of this action.

Integration of Other Products/Applications

MobileChat benefits from cooperation and/or integration with several third-party applications with which MobileChat may be integrated or utilized, including QuickShareIt. Any user of the MobileChat Site, or of any affiliated and/or co-branded products with MobileChat, engages in the use of an feature offered jointly by any third party hereby represents that they have read and agreed to the terms of service and privacy policy of any such third party application as listed in the affiliated website.

Children

MobileChat does not intend to collect information from individuals who identify themselves as under thirteen (13) years of age. If you are under thirteen, you should not provide any personal information on the MobileChat Site. MobileChat will not knowingly disclose personally identifiable information of children under thirteen to any third party.

How Does MobileChat Protect My Information?

MobileChat takes technical, contractual, administrative and physical security steps to protect all visitor and contact information from unauthorized access, maintain data accuracy and enable the correct use of information. MobileChat utilizes security systems to protect such information.

If you have an account with MobileChat, your account is password-protected so that only you, or a party you authorize, can access it and view your Personal Identification Information. To protect your privacy, you should not give your password to anyone else. Remember to log out and close the window when you have finished with the Site. This helps to ensure that no one with whom you may share a computer can access your information.

How Does MobileChat Use My Information and With Whom Do We Share the Information?

MobileChat does not share, rent, lease or sell Personal Identification Information to others in ways different from what is disclosed in this Privacy Policy. However, because the market for mobile-based applications and custom Internet-based applications is a rapidly evolving business, and MobileChat desires to continue to develop and enhance its business, MobileChat may become subject to a corporate merger, corporate acquisition, or similar transaction involving the sale or combination of substantially all of its assets. In such circumstances, MobileChat reserves the right to disclose your Personal Identification Information to the merged or resultant business entity under the same terms and conditions as set forth in this Privacy Policy. In addition, MobileChat may share and/or transfer certain of your Personal Identification Information to third parties for the express purpose of improving and/or enhancing the services offered by our product. Protection of MobileChat and Others; Compliance with the Law

MobileChat reserves the right to disclose your Personal Identification Information if required to do so by law or in the good faith belief that such action is reasonably necessary to (a) comply with legal process, (b) respond to any claims against it, or (c) protect the rights, property or personal safety of MobileChat, its employees, its customers or the public. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

The Site may contain links to other sites. MobileChat is not responsible for the privacy practices or the content of such other sites. MobileChat encourages you to review the privacy policies posted on these third-party sites.

Accessing or Updating Information; Opting-Out

Please notify us of any changes to any of your Personal Identification Information that you have previously provided to us, including name, address, title, phone number or e-mail address by sending an email to mcsupport [at] mobilech.at . Conditions of Use; Contacting Us

Please check the MobileChat Site frequently to see recent changes, additions and deletions to this Privacy Policy. Please also see our Site's Terms of Use for other terms and conditions governing your use of our Site and our products and services. If you have objections to the Privacy Policy, you should immediately discontinue use of the Site and the Products and Services enabled by the Site. Although we will periodically place notices on our Site or send e-mails to Site users informing them of updates, you acknowledge by using our Site that Mobile Apps has the right, at our sole discretion, to modify, add or remove any terms and conditions of this Privacy Policy without prior notice or liability to you. Unauthorized Use of MobileChat

This Privacy Policy applies ONLY to users who have legitimately and legally purchased the MobileChat application through the iTunes AppStore or in any other manner explicitly approved by Mobile Apps. Any unauthorized use of MobileChat, including possession, use or control over any unauthorized or illegal copy of the MobileChat software, renders MobileChat free to disregard the terms and conditions set forth herein with respect to any such unauthorized user. Unauthorized users of MobileChat therefore confirm, by using the Site, that MobileChat is not bound to adhere to the terms and conditions set forth herein with respect to their privacy.
